Terms of Service

These Terms of Service ("Terms") govern your use of BoomBoom World("Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service. You must be at least 18 years old and a parent or legal guardian to register.

We provide tools for parents and guardians to create personalised illustrated characters for their children, including uploading a child's photo to generate an avatar they can save to a private account.

Features may change, be added, or be withdrawn. Beta or preview features may be less reliable or incomplete.

• You are responsible for your account credentials and all activity under your account.
• You must provide accurate account information and keep it up to date.
• Notify us promptly if you suspect unauthorised access.
• One account should not be shared with unrelated third parties.

You represent and warrant that you are the parent or legal guardian of any child whose information or photo you submit, and that you have the right to provide that photo for avatar creation.

You must not upload photos of children you do not have authority over, or photos containing other identifiable individuals without their consent where required.

Parental consent is required before we process a child's photo. Consent terms are described in our Children's Privacy & Parental Consent notice.

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes.
• Upload malware, offensive content, or material that infringes intellectual property or privacy rights.
• Attempt to bypass security, access other users' data, or scrape the Service.
• Reverse engineer or misuse AI-generated outputs to impersonate others or create deepfakes outside the Service.
• Resell, sublicense, or commercially exploit the Service except as expressly permitted.

We may suspend or terminate accounts that violate these rules or pose a risk to children, other users, or the platform.

We own or license the Service, illustrations, software, branding, and underlying technology. You receive a personal, non-exclusive licence to download and use completed character artwork for your family and private, non-commercial purposes unless we agree otherwise in writing.

You retain rights in photos you upload. You grant us a limited licence to host, process, and transform those photos solely to provide the Service (including avatar generation).

AI-generated avatars are provided for use within your account. They are not a guarantee of likeness and should not be used to misrepresent identity outside the Service.

Where paid products are offered, prices, taxes, and payment terms will be shown at checkout. Digital character delivery is typically via your private account. Refund policies, if any, will be stated at the point of purchase.

The Service is provided "as is" and "as available". Illustrated characters are artistic interpretations and may not perfectly match a child's appearance. We do not warrant uninterrupted or error-free operation.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (including for death or personal injury caused by negligence, or fraud).

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for claims relating to the Service in any 12-month period is limited to the greater of (a) amounts you paid us for the Service in that period or (b) £100, except where a higher limit is required by law.

You may stop using the Service at any time and delete child profiles from Settings. We may suspend or terminate access for breach of these Terms or to protect the Service and its users.

Provisions that by nature should survive (including intellectual property, disclaimers, and limitations of liability) survive termination.

These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence where applicable.
